Terms of Service

1. Beta Software — Use at Your Own Risk

Capsul is an experimental, independently-developed, beta-stage platform. It is a personal project, not a commercial product backed by a company or team. It is provided entirely as-is, with no guarantees of any kind.

By accessing or using Capsul, you expressly acknowledge and agree that:

• You are using unfinished, beta software that may contain bugs, errors, and critical issues.
• The platform may go offline, break, lose your data, or be shut down permanently at any time and without prior notice.
• Features may be added, changed, or removed at any time without notice.
• You assume all risks associated with using beta software, including but not limited to data loss, incorrect outputs, and service interruptions.
• You should never rely on this platform for anything critical, time-sensitive, or production use.

2. AI Makes Mistakes — You Are Responsible

Capsul uses large language models (LLMs) via third-party AI providers (Groq, OpenRouter, NVIDIA NIM, and others) to generate application code and content. AI is not infallible. You acknowledge and agree that:

• AI-generated code and content will contain mistakes, including logic errors, security vulnerabilities, incorrect calculations, and factual inaccuracies.
• AI models can produce output that is confidently wrong, broken on first run, or unsuitable for your intended use case.
• You are solely and entirely responsible for reviewing, testing, understanding, and validating all AI-generated code before using it for any purpose.
• Capsul makes absolutely no warranty that any generated app is correct, secure, bug-free, or production-ready.
• You must not deploy AI-generated apps in regulated industries (healthcare, finance, legal, etc.) or in any context where errors could cause harm, without thorough independent review by a qualified professional.
• Capsul and its developer are not liable for any harm, loss, or damage caused by acting on AI-generated output.

3. Back Up Your Data — We Are Not Responsible for Data Loss

Capsul stores app data and SQLite databases on a best-effort basis only. We explicitly disclaim all liability for any data loss. This is a beta platform. Data loss can and does happen. You acknowledge:

• Your apps, generated code, and database records can be lost at any time due to server failures, infrastructure changes, bugs, or platform shutdowns.
• There are no guaranteed automated backups of your data.
• AI-generated SQL operations running inside your apps can corrupt or destroy stored data.
• Version history is limited and stored on a best-effort basis — it is not a reliable backup system.

⚠ You must download and keep your own backups of any apps or data you care about. Use the download feature regularly. Do not assume your data is safe here.

4. Limited Support

Capsul is maintained by a single developer on a best-effort, no-commitment basis. There is no dedicated support team, no guaranteed response time, and no SLA. You should expect:

• Little to no technical support for issues you encounter.
• Bug reports may or may not be addressed.
• Feature requests may or may not be implemented.
• No guaranteed fixes or rollback for issues that cause data loss or service disruption.

If you need enterprise-grade support, SLAs, or reliability guarantees, this platform is not suitable for your use case.

5. AI Provider Data Practices — Your Prompts May Be Tracked

When you use Capsul to generate apps, your prompts, context, and any data included in your requests are sent to the third-party AI provider you have configured. Free-tier AI models in particular may log, store, review, or use your prompts for model training. You acknowledge:

• Free or low-cost AI models offered by providers like Groq, OpenRouter, and NVIDIA NIM may track your prompts and usage data per their own policies.
• Your prompts, app descriptions, and generated content are processed on third-party infrastructure outside Capsul's control.
• You should never include sensitive, confidential, or personally identifiable information in your prompts.
• Capsul is not responsible for how third-party AI providers handle your data.

Always review the privacy policies and terms of your chosen AI provider: Groq, OpenRouter, NVIDIA.

6. Platform Usage Tracking

Capsul tracks platform usage data to operate the service and enforce limits. This includes:

• Number of AI generations per user (to enforce rate limits).
• Number of apps created and total app count per account.
• Feature usage patterns for platform improvement.
• Authentication events via Firebase Authentication.

This data is used solely to operate and improve the platform. It is not sold to third parties. See the Privacy Policy for full details.

7. Your API Keys

You bring your own API keys for Groq, OpenRouter, NVIDIA NIM, or other configured providers. Your use of those services is governed entirely by their respective terms of service. You acknowledge:

• API keys are stored encrypted at rest, but Capsul makes no guarantee of absolute security.
• You are solely responsible for your API key usage and any charges or quota consumption incurred through Capsul.
• Rotate your API keys immediately if you suspect any compromise.
• Capsul is not liable for any API charges, quota overuse, or account issues with your AI provider caused by your use of this platform.

8. No Verification of Generated Output

Capsul does not audit, verify, or validate any AI-generated application for correctness, legality, safety, security, or appropriateness. The developer is not responsible for:

• Security vulnerabilities in generated code.
• Incorrect business logic, false calculations, or misleading outputs.
• Any intellectual property issues in generated content.
• Any harm caused by apps you build and share with others.
• Any legal, regulatory, or compliance issues arising from apps built on this platform.

9. Acceptable Use

You agree not to use Capsul to build or deploy applications that:

• Violate any applicable laws or regulations.
• Infringe upon the intellectual property or rights of any third party.
• Spread misinformation, enable harassment, or contain harmful content.
• Attempt to abuse, exploit, overload, or reverse-engineer the platform.
• Collect personal data from others without proper consent or disclosure.

10. Service Availability

No guarantees are made about uptime, availability, or continuity of service. Capsul may experience downtime, undergo breaking changes, lose stored data during migrations, or be permanently discontinued at any time. Reasonable efforts may be made to notify users of significant changes, but this is not guaranteed.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. THE DEVELOPER MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

12. Limitation of Liability — No Legal Action

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAPSUL AND ITS DEVELOPER(S) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

• Loss of data, apps, or databases.
• Loss of profits, revenue, or business opportunities.
• Business interruption or loss of goodwill.
• Costs of procuring substitute services.
• Any harm resulting from AI-generated code or content.
• Any harm resulting from reliance on the platform or its outputs.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH DAMAGES ARE SOUGHT, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, THE DEVELOPER'S LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. IN NO EVENT SHALL TOTAL LIABILITY EXCEED $0 USD, AS THIS IS A FREE PLATFORM PROVIDED WITHOUT CHARGE.

13. Indemnification

You agree to indemnify, defend, and hold harmless Capsul and its developer from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of or access to the platform; (b) your violation of these Terms; (c) any app you build, deploy, or share using this platform; or (d) any harm caused to a third party through your use of the platform.

14. No Professional Advice

Nothing generated by or communicated through this platform constitutes legal, financial, medical, or any other form of professional advice. Do not rely on AI-generated content as a substitute for qualified professional judgment.

15. Changes to These Terms

These terms may be updated at any time without prior notice. Continued use of Capsul after updated terms are posted constitutes your acceptance of the new terms. It is your responsibility to review these terms periodically.

16. Governing Law

These terms shall be governed by and construed in accordance with applicable law. Any disputes shall first be attempted to be resolved informally. By using this platform, you waive any right to participate in class-action lawsuits or class-wide arbitration against the developer.
